Legal Psychedelic Places in the US

The legalization of cannabis across the nation has led to the resurgence of another movement. Over the past three years, different resolutions and measures have decriminalized or legalized natural entheogenic substances. These resolutions and measures continue to spring up in different parts of the country.

Some substances considered entheogenic are peyote, ibogaine, mescaline, ayahuasca, and psychedelic mushrooms. It’s worth noting that MDMA and LSD are part of these decriminalization measures.

Across the United States, Oregon is the only state where psilocybin is legal for therapeutic use. Many other counties and cities have decriminalized psilocybin, alongside other entheogenic substances. Decriminalization implies that law enforcement agencies will deprioritize prohibition enforcement for these substances. Also, entheogenic substances are still illegal in these counties and cities.

Oregon

The vote supporting Measure 110 was in November 2020. This vote was to minimize the penalty for people possessing drugs in small quantities. According to the new law, the penalty for being caught in possession of these substances was a fine of $100

Ann Arbor/Washtenaw County, MI

The Ann Arbor City Council had a collective vote to decriminalize the possession, cultivation, and use of naturally occurring entheogens. This vote was in September 2020. Also, Washtenaw County eventually expanded the application of this measure across the county. However, anyone drying under the influence of any entheogen will be charged by law enforcement.

Arcata, CA

The Arcata City Council had a collective vote to decriminalize natural entheogens for adults in October 2021.

Cambridge, MA

The second city in Massachusetts to decriminalize entheogens was Cambridge, and this was in February 2021. Based on the policy, the city cannot allocate funds to facilitate the arrest or prosecution of people bearing entheogens.

Denver, CO

Voters in Denver approved measures for decriminalizing psilocybin possession and use in May 2019. The law was effected in March 2020. Today, possessing Schedule I or Schedule II substances is a misdemeanor in Denver.

Detroit, MI

Measures to decriminalize entheogenic fungi and plants in Detroit were passed in November 2021.

Easthampton, MA

The Easthampton City Council had a collective vote to decriminalize entheogenic fungi and plants in October 2021.

Hazel Park, MI

Hazel Park City Council had a collective vote to decriminalize entheogenic fungi and plants in March 2022.

Northampton, MA

The Northampton City Council had a collective vote to decriminalize entheogenic fungi and plants in March 2021.

Oakland, CA

Oakland City Council became the first US city to collectively vote to decriminalize entheogenic fungi and plants. This was in June 2019.

Port Townsend, WA

Port Townsend City Council had a collective vote to decriminalize entheogenic fungi and plants in December 2021.

San Francisco, CA

The San Francisco Board of Supervisors had a collective vote to decriminalize entheogenic fungi and plants in September 2022.

Santa Cruz, CA

The Santa Cruz City Council had a collective vote to decriminalize the cultivation and possession of entheogenic fungi and plants in February 2020.

Seattle, WA

The Seattle City Council had a collective vote to decriminalize entheogenic fungi and plants in October 2021.

Somerville, MA

Somerville City Council had a collective vote to decriminalize the possession and use of entheogenic fungi and plants in January 2021.

Washington, DC

Washing DC City Council had a collective vote to decriminalize the possession and use of entheogenic fungi and plants in November 2020.
